Terms of use

These terms are an agreement between you and UpLevel Technologies LLC (“we”) for using the Tkay apps and services. By creating an account you accept them. Our privacy policy explains how we handle your data.

Your account

You need to be at least 13, and old enough to agree to these terms where you live (or have a parent or guardian agree for you). Keep your sign-in secure; you’re responsible for what happens in your account. If you create a shared workspace, you decide who joins and what they can do.

Your content

What you capture and create in Tkay stays yours. You give us permission to store, process and display it only as needed to run Tkay for you and the people you share it with, including sending it to the providers listed in the privacy policy. That permission ends when you delete the content or your account, apart from copies we must keep by law.

Only add content you have the right to use. That includes code repositories: connect only repositories you’re allowed to change.

Drafts, AI and results

The crew’s plans, drafts and results can be wrong or incomplete, especially when AI writes them. Tkay shows you what it checked and what is still to learn, but you decide what to keep and use. Review a draft before you rely on it, publish it, or merge it into your code. Tkay never merges or deploys code; it opens draft pull requests only after you approve.

If you see a draft that is harmful or offensive, use Report this draft in the app.

Acceptable use

Don’t use Tkay to:

• break the law or infringe anyone’s rights;
• create content that harasses, threatens, sexualises minors, or promotes violence;
• build malware, attack systems, or get around security, including Tkay’s own limits and sandboxes;
• access accounts, workspaces or repositories that aren’t yours to use;
• copy, resell or reverse engineer Tkay, or use it to train a competing model.

We may remove content or suspend accounts that break these rules, and we’ll tell you why unless the law or safety prevents it.

Purchases

Paid plans and credits are sold through the App Store or Google Play and are subject to their terms. The price, what you get and, for subscriptions, how often it renews are shown before you buy. Subscriptions renew automatically until you cancel them in your App Store or Google Play account settings, at least 24 hours before the renewal date. Credits have no cash value and can’t be transferred. Refunds are handled by Apple or Google under their policies.

Changes and availability

Tkay is in private testing. Features may change, and the service may be unavailable at times. If we change these terms in a way that matters, we’ll tell you in the app before the change takes effect.

Ending your account

You can delete your account any time in the app (Account → Your data → Delete my account) or by email. We may end or suspend accounts that seriously or repeatedly break these terms. Sections about content you’ve shared, disclaimers and liability continue after an account ends.

Disclaimers

Tkay is provided “as is” and “as available”. To the extent the law allows, we disclaim implied warranties, including merchantability, fitness for a particular purpose and non-infringement, and we don’t promise that results will be accurate or that the service will be uninterrupted.

Limit of liability

To the extent the law allows, we aren’t liable for indirect, incidental, special or consequential damages, or for lost profits, data or goodwill. Our total liability for any claim about Tkay is limited to the greater of the amount you paid us in the 12 months before the claim, or US$50. Nothing here limits liability that can’t be limited by law.

Apple and Google

These terms are between you and us, not Apple or Google. Apple and Google aren’t responsible for Tkay, its support or maintenance, or claims about it. If you downloaded Tkay from the App Store, you may use it on Apple devices you own or control as the App Store’s usage rules allow. If Tkay fails to meet any applicable warranty, you may tell Apple, and Apple may refund the purchase price, if any; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you aren’t in a country under a US government embargo and aren’t on a US government list of prohibited parties.
